The invention discloses an electric vehicle motor controller discharge circuit and a vehicle. The discharge circuit comprises a sampling circuit, a microprocessor and a discharge execution circuit; the sampling circuit and the discharge execution circuit are both connected in parallel with a bus of a motor controller; the output end of the sampling circuit is connected with the first input end ofthe microprocessor, and the output end of the microprocessor is connected with the input end of the discharge execution circuit; the sampling circuit is used for collecting a bus voltage value of themotor controller and transmitting the bus voltage value to the microprocessor; and the microprocessor is used for determining a discharge instruction and a duty ratio of the discharge instruction according to the bus voltage value and transmitting the discharge instruction to the discharge execution circuit, so the discharge execution circuit discharges when the discharge instruction is at a low level, and the discharge instruction is in a pulse width modulation form. According to the invention, the first resistor works in an intermittent discharge state, the power of the first resistor can bereduced, and the temperature rise rate of the first resistor is reduced.
