In the mid and late 1980s and early 1990s, a significant number of new starts and additions to existing transit systems were initiated throughout the United States and Canada. As construction on these programs got under way, it was soon recognized that management of disputes and claims required a major focus of management, to maintain projects and programs within overall budget and time parameters. This synthesis was initiated to study the underlying reasons for construction contract disputes in transit construction and to identify methods used for dispute avoidance and resolution. The synthesis focuses on the avoidance and resolution of disputes and examines ways of settling disputes at their inception, before they become formal claims or lawsuits. It also considers the experiences of the transit industry with the use of alternate dispute resolution techniques.
