To provide an occupant state recognition apparatus, method and program for determining a viewing state of an occupant while selecting whether to use a line-of-sight direction, in accordance with the accuracy of imaging information of an in-vehicle camera.SOLUTION: An occupant state recognition apparatus 1 which recognizes an occupant state by determining a viewing state of an occupant on a vehicle includes: an occupant information acquisition unit 11 which acquires a face direction and a line-of-sight direction of an occupant on the basis of imaging information of a driver monitor camera 2 in a vehicle; a distance acquisition unit 12 which acquires a distance from the driver monitor camera 2 to the head of the occupant, on the basis of ranging information of a ranging sensor 3 in the vehicle; and a viewing state determination unit 13 which determines a viewing state of the occupant on the basis of at least one of the distance, the face direction, and the line-of-sight direction. The viewing state determination unit 13 determines, when the distance is equal to or smaller than a predetermined far distance threshold regarding acquisition of a line-of-sight direction, a viewing state of the occupant on the basis of the line-of-sight direction, or determines, when the distance is larger than the far distance threshold, the viewing state of the occupant on the basis of the face direction.SELECTED DRAWING: Figure 1
