Considering the goal of the paper and the presented results, statements the following conclusions can be drawn. It is worth starting a wide range of tests for specifying the fracture mechanics material properties of rail steels, both by quasi-static, dynamic and cyclic loading conditions. On the basis of the great number of results gained we must determine their statistical features in function of temperature. In possession of the above data, we can make a fair and technically based estimation of the risk of kidney-shaped cracks in the rails, taking into account the temperature and the impact effect of flat wheels. It is important to control and exclude the flat wheels regularly. During the production of new rail steels it is inevitable to perform fracture mechanics inspection tests. These must include the testing of welded joints.
