Unmanned Aerial Vehicles (UAVs), referred to as drones, are an integral part of the aviation industry. According to a study conducted by the Single European Sky Air Traffic Management Research (SESAR), it is estimated that the drone industry will be worth € 10 billion annually by 2035. The rapid growth in the use of drones undoubtedly provides many commercial benefits and unique opportunities for future use, but, at the same time, it also raises many challenges particularly with regards to using UAVs for civilian purposes. Safely integrating UAVs into non-segregated airspace while safeguarding the rights of all airspace users requires careful planning, the cooperation of all stakeholders as well as a very robust and effective legal framework. Unmanned aircraft are subject to civil regulation under the International Civil Aviation Organization (ICAO) and under regional and national aviation authorities. The chapter will provide an overview of the legal and regulatory framework with regards to integrating UAVs in nonsegregated airspace by providing a discussion and critical analysis of regulations by the ICAO on an international level and the European Aviation safety Agency (EASA) and the American Federal Aviation Administration (FAA) on a regional level before going on to highlight and discuss some of the legal complexities and challenges of UAVs operating in non-segregated airspace.
