A developer in the City of Conservative has a commercial parcel that he wishes to develop. The City zoning rules require him to deal with any traffic impacts his development creates, and for any new development to provide on-street parking plus a minimum of 5 feet in each direction for non-vehicular traffic (bicycles) in the street. The developer approached the consultant firm, XYZ Engineers, for a proposal to do the work with the caveat that any project must be developed within the existing right of way. XYZ Engineers should clearly discuss with the developer the requirements that must be met and associated costs to obtain City approval based on preliminary discussions with the City. It is reasonable for XYZ Engineers to offer a proposal to do the work as long as the issues are clearly identified. It is not reasonable for XYZ Engineers to offer assurances the project will be permitted as envisioned as zoning exceptions and non-standard design features are anticipated.
