A seatbelt assembly includes a seatbelt 26, a conductive sensing conductor 54 and a conductive shield 56. The seatbelt has a lap band. The conductive sensing conductor is fixed to a first side of the lap band. The conductive shield is fixed to a second side of the lap band and is substantially aligned with and substantially overlaps the sensing conductor. An insulating layer 57 is disposed between the sensing conductor and the conductive shield. When the seatbelt is correctly fastened over the occupant, the sensing conductor senses and measures the capacitance associated with a conductive body, i.e. the occupant. The capacitance of the occupant effects a frequency generated by a timer and thus informs the system of an occupant. The invention may also comprise a spool, a retractor, a latch plate or an anchor. In another embodiment, a restraint system comprises the first invention and also comprises a sensing circuit connected to the conductor and the shield. A grounding element may also be located in the seat base.
