The invention discloses an autonomous vehicle driver takeover capability confirmation method and an autonomous vehicle. The method is applied to an ADS ECU on an automatic driving vehicle and comprises the steps that a plurality of driving state indexes of a driver are continuously monitored; the plurality of driving state indexes comprise a plurality of indexes selected from a driver in-place index, a driver view staying area index, a driver fatigue state index, a driver hand leaving index, a driver safety belt state index, a driver hand-held telephone index and a driver and passenger communication index; when a takeover request is received, judging whether the driver has the takeover capability or not according to a plurality of driving state indexes of the driver; if the driver is judged to have the takeover capability, the driving authority is transferred to the driver; and if the driver does not have the takeover capability, executing a minimum risk strategy. According to the method, the comprehensive takeover capability of the driver can be comprehensively evaluated from different angles and dimensions before the vehicle control authority is transferred, and the safety risk caused by insufficient takeover capability is reduced.
