In accordance with the new requirements of rail law, from June 2020, a railway undertaking or rail infrastructure manager applying for a single safety certificate/ authorization should demonstrate compliance with the relevant requirements of the Safety Management System (SMS) set out in the Commission delegated regulation (UE) 2018/762. To this end, he should provide proof to the national safety authority or, where applicable, to the European Union Agency for Railway Safety, of the establishment of a safety management system in accordance with Art. 9 of Directive (EU) 2016/798. According to Regulation, the organization should describe the scope of the safety management system, indicating which parts of the business are covered by it, considering legal requirements.
