Abstract: This research with title “Civil liability due to air crashes of Military flights” seeks to investigate and explain the Criminal liability of the military pilots and their responsibility for the occurrence of air accidents and the entry of injury to the people and their facilities. Due to the inadequacy of the general rules of criminal liability in this area, the researcher tried to draw up a specific system of liability in this area inspired by the conventions relating to air accident rights, such as the Warsaw Convention, to protect these rules and support the people who receive injuries. The mythology of research was qualitative and use from thematic analysis. The statistical population included books and documents that sample were also considered to be similar to the community. The study said that, in the event of an air crash and the occurrence of injuries to third parties, the government, as the flight operations employer, and the pilots, have criminal liability as drivers of aircraft vehicles. Although the government's responsibility for such injuries is not due to the government's fault but criminal liability of the pilots will be subject to their own fault. In addition, pilots can be prosecuted if they commit one of the criminal blame under the Islamic Penal Code such as causing personal injury through.
