The invention relates to the field of emulsion polymerization, and discloses copolymer microgel latex as well as a preparation method and application thereof, monomers for forming a copolymer in the copolymer microgel latex comprise a conjugated diene monomer, a monovinyl aromatic monomer, a vinyl unsaturated carboxylic acid monomer, a crosslinking monomer and a monomer containing an epoxy functional group; the surface of the copolymer is grafted with an epoxy monomer. The vulcanized rubber of the rubber composition containing the copolymer microgel achieves better balance in the aspects of rolling resistance, wet skid resistance and wear resistance, and is suitable for manufacturing tread rubber of tires.
