As a typical application of artificial intelligence in transportation industry, automatic driving technology has made great progress in recent years. Autonomous vehicles are proved to have advantages in the aspects of easing traffic jam, enhancing traffic operation efficiency and improving traffic safety. Major automotive companies and Internet enterprises such as Google, Toyota, Nissan, Audi, Tesla have begun to develop autonomous car and turned it into reality. However, numerous traffic accidents involving autonomous vehicles emerge all over the world with the gradual commercialization of autonomous cars. The problem of how to deal with these accidents have sparked heated discussion, attribution of accident responsibility is the most important issue among them, which will directly influence the industrialization and marketization of autonomous vehicles. However, the existing tort liability system is built on the basis of human driving behavior, which is not entirely applicable to the accidents of autonomous vehicles, and legislation on the attribution of responsibility for accidents involving automatic driving has not yet been established. This paper discusses the responsibility attribution of automatic driving accidents and defines the responsibility attribution of automatic driving accidents based on the intelligent levels of autonomous vehicles, discusses the probability of giving autonomous vehicles legal personality and the enforcement of automatic driving law, which provides the theoretic basis and thinking for the policy making of the responsibility attribution of automatic driving accidents. The solution of this problem is conducive to the development of the industry of automatic driving and promotes the real landing of automatic driving industry.
