A number of entrepreneurs are committed to the goal of developing and operating reusable launch vehicles for private human space travel. In order to promote this emerging industry, and to create a clear legal, regulatory, and safety regime, the United States (U.S.) Congress passed the Commercial Space Launch Amendments Act of 2004 (CSLAA). Signed on December 23, 2004 by U.S. President George W. Bush, the CSLAA makes the Federal Aviation Administration (FAA) responsible for regulating human spaceflight. The CSLAA, among other things, establishes an experimental permit regime for developmental reusable suborbital rockets. This paper describes the FAAs approach in developing guidelines for obtaining and maintaining an experimental permit, and describes the core safety elements of those guidelines.
