The brake-by-wire system comprises the following working states: a standby state, an active holding state, an overtime state and a release state, and an electronic control unit of the brake-by-wire system is configured to determine the working state of the brake-by-wire system according to the vehicle state information and a preset triggering condition, wherein the vehicle state information at least comprises in-place state information of a driver. Meanwhile, the invention further provides an electric automobile comprising the brake-by-wire system. According to the embodiment, accidents caused by the fact that a driver does not perform effective braking when leaving the vehicle can be effectivelyreduced or avoided.
