Construction and renovation are an ever-present part of port development in this changing world. An element of construction that has been continuously evolving over the past 10–15 years, that cannot be ignored, is an owner's involvement in construction safety. The traditional risk transfer or contractual hold-harmless indemnification clauses of the past are being challenged in the legal and regulatory arenas. The question remains — what is the appropriate level of involvement in construction safety oversight and construction safety programs. Furthermore, other motivating factors play into decisions for active involvement such as: avoiding impacts to tenant operations; maximizing profits for the Port with an owner controlled insurance program; being a good community citizen; or avoiding negative publicity. Whatever the objective of a construction safety program, a concentrated focus on contractor safety improves overall results. This has become self-evident through a case study on performance of contractors involved in the Capital Improvement Program at the Port of Seattle. A concentrated focus started with pre-planning by the Port to ensure specific performance requirements were communicated to the contractor via the contract specifications. This was followed by the contractor's development of comprehensive site-specific safety plans. The two were interfaced with evaluations by the Port's construction safety group to ensure the plans were sufficient to address hazards within the scope of work to be performed. Developing a systematic approach of current best practices to pre-plan safety increased the overall effectiveness of the contractor's performance reducing the incident frequency and hazard identification frequency; hence, overall reducing potential impacts to the port operations.
