Southwest-bound (timetable westbound) BNSF Train Symbol Z-WSPRIC9-26 collided with a westbound pickup truck at a passive highway-rail grade crossing, DOT No. 009541H, on May 27, 2006, at 12:55 p.m., CST The accident occurred 4 miles southwest of Cassoday, Kansas, at BNSF Milepost 161.5, on the BNSF Emporia Subdivision. There were three fatalities; a male believed to be the driver, age 61; a female passenger, age 60; and a male passenger, age 41. Damage to the lead locomotive was estimated at $500. The vehicle damage was estimated at $5,000. At the time of the accident it was daylight and clear, and the temperature was 85oF. Sight distance was not a factor. The Butler County Sheriff's Department investigated the accident. An eyewitness stated that it appeared the pickup truck driver crossed the highway-rail grade crossing and then backed up onto the track. Toxicology tests were not performed on train crew. The accident was caused by the failure of the motor vehicle driver to yield to the train.
