In response to your request, this report examines the issues associated with changing how railroad workers are compensated for their work-related injuries. In particular, we identify the potential implications for railroad costs and railroad workers for (1) replacing the Federal Employers' Liability Act (FELA) with a no-fault compensation system of (2) modifying FELA. We also discuss FELA's effects on small railroads and the availability and affordability of insurance to protect small railroads against large FELA payouts.
