The present invention relates to an automatic emergency braking apparatus, which can prevent automatic emergency braking from being performed according to a driving habit of a driver even in a situation where there is no collision with a preceding vehicle when changing a lane, and a method thereof. The automatic emergency braking method of the present invention comprises the following steps of: detecting a relative distance between an own vehicle and the preceding vehicle; detecting a lane changing intention of the driver from a sensor installed in the own vehicle; and performing a normal automatic emergency braking if the lane changing intention is not confirmed, and not performing the automatic emergency braking if the lane changing intention is confirmed and the relative distance to the preceding vehicle is equal to or greater than a threshold.

    본 발명은 차선 변경시에 선행 차량과 충돌이 되지 않는 상황에서도 운전자의 운전 습관에 따라 자동 비상 제동이 수행되는 것을 방지할 수 있는 자동 비상 제동 장치 및 방법에 관한 것이다. 본 발명의 자동 비상 제동 방법은 자기 차량과 선행 차량 사이의 상대 거리를 검출하는 단계와, 상기 자기 차량 내 장착된 센서로부터 운전자의 차선 변경 의도를 검출하는 단계와, 상기 차선 변경 의도가 확인되지 않으면 정상적인 자동 비상 제동을 수행하고, 상기 차선 변경 의도가 확인되고 상기 선행 차량과의 상대 거리가 임계값 이상인 경우에는 자동 비상 제동을 수행하지 않는 단계를 포함한다.
