The invention relates to the technical field of automobiles and discloses a brake apparatus preventing mistakenly stepping on the accelerator and an automobile. The brake apparatus preventing mistakenly stepping on the accelerator is mainly used in cases where drivers mistake accelerators for brakes and step on the accelerators. The brake apparatus comprises: a brake pedal which is rotationally arranged inside an automobile cab; a brake component which is driven by the brake pedal; and a rotational connecting rod which connects the brake component and the brake pedal. An emergency brake component is connected to the rotational connecting rod. The emergency brake component comprises a connecting rod, wherein two ends of the connecting rod are respectively hinged to the rotational connecting rod and a separating board inside the automobile cab. The middle part of the connecting rod is connected to a second hydraulic cylinder. The second hydraulic cylinder is connected to a third hydraulic cylinder through a hydraulic pipeline. The third hydraulic cylinder is electrically connected to a sensing device. In this way, by use of an additional emergency brake component which brings little refit workload and low cost, even a driver steps on an accelerator instead of a brake by mistake, the automobile can still be braked in time and thus traffic accidents are reduced. The brake apparatus and the automobile are easy for market popularization and have good market prospect.
