This report concerned the death of a 43 year old male painter who died after falling from the deck of an elevated aerial platform while painting a ceiling inside a fitness center. The employer was a painting contractor which had been in business for 4 years, employing 20 workers. A three man crew had been at the site for about 2 weeks. Access to the 16 foot high ceiling was from electrically powered scissors type aerial platforms. The painters were applying an alkyd dry fog paint using airless spray equipment. The protective railing on the platform had been rigged so that it was 35 inches above the deck on one side and 26 inches on the other; the safety chains across the open end of the guard railing were not secured. While the fall was unwitnessed, nearby workers heard the noise of the fall. The victim died the following day of a closed head injury.
