The autopsy of aircraft accident victims is an important aspect in the investigation of the accident. Three jurisdictions--the National Transportation Safety Board, the military services and state of local coroners or medical examiners--have authority, under certain circumstances, to obtain autopsies of aviation fatalities. The legal basis for autopsy by each jurisdiction is examined with a focus upon areas in which the authority of one may intersect that of another. These jurisdictional problems are aggravated by the fact that the purposes and objectives of the three jurisdictions in obtaining autopsies often differ. Statutes and regulations broadly divide the responsibilities of the NTSB and the military services and tend to reduce the occasion for conflict between these jurisdictions. Jurisdictional problems between federal and local authorities may best be avoided by effective communication, but if conflicts persist, the supremacy of federal law will allow the federal jurisdictions to obtain autopsies.
